US Immigration Update (October 1, 2020): The U.S. District Court for the Northern District of California granted the motion for preliminary injunction temporarily halting the implementation of USCIS final fee rule in its entirety and on a nationwide basis. This means that the new fee increases have been STOPPED, at least for now. We will update this webpage with information and guidance on further developments. Please check back frequently.

What happens next?
The Government (USCIS) will likely appeal to the 9th Circuit court to get the fee increases pushed through. However, no one knows when the appeal will happen or what the result of the appeal will be.

What does this mean for you?
No one knows if or when the new fees will be made effective, but as long as the injunction is in place the USCIS cannot raise fees. Taking into consideration that fees could go up for many applications at any time, it's generally a good idea to prepare & file your Green Card or Citizenship applications sooner rather than later.

See the chart below to see the differences in the current vs new fees.

Green Card for Parents

Permanent residents and Citizens of the United States can help their parents immigrate to the United States by filing a petition for a Green Card. This application, in very plain words, asks the government's permission for a resident's relative to join them in the United States.

The person requesting the relative is called the sponsor, while the immigrant is sometimes called the petitioner.

Green Card for Parents of U.S. Citizens

Parents of United States citizens are Immediate Relatives, meaning that they do not have to wait for a visa to become available for their immigration to the U.S. Immediate Relatives do not face a limit in terms of visa availability.

Applying for Permanent Residency (Green Card)

The process for getting an actual green card requires another form, which is also included. This form is the official request an immigrant sends to the U.S. government to be registered as a permanent resident in the United States.

The proof of this permanent residency comes in the form of a Green Card. Immigrants who have a Green Card have access to a great many opportunities in the U.S., including:

  • The right to work anywhere in the U.S.
  • The right to live wherever they like in the U.S.
  • The right to sponsor the immigration of family members and
  • The chance to apply for citizenship.
