  • The Application to Extend/Change Nonimmigrant Status, Form I-539, is used by temporary visitors to continue their visit to the United States. It is also used to change a nonimmigrant status.
  • When to file Form I-539
    Be sure to submit the application in advance of your current visa's expiration to avoid visa problems with the USCIS.
  • Who can file an Application to Extend or Change Nonimmigrant Status?
    These are some situations in which one can use Form I-539:
    • Holders of B-1, B-2, F-1, M-1 or M-2 visas can apply to extend their status using Form I-539 and stay in the U.S. longer.
    • If you have a B-1, B-2, F-1, F-2, J-1, J-2, M-1 or M-2 visa you can use Form I-539 to change your visa to any of those visa statuses mentioned. M-1 students cannot change to F-1 student status, however.
    • The Application to Extend/Change Nonimmigrant Status, Form I-539, can also be used to reinstate status for expired F-1 and M-1 visa holders in some cases.
    • CNMI (Commonwealth of the North Marianas Islands) residents looking to apply for status for the first time can use Form I-539.
    • Recipients of a V nonimmigrant visa can use this form to apply for the first time or to extend their status.
  • You can apply for yourself, your spouse and your unmarried children under the age of 21 on the same Form I-539 at the same time to extend your entire family's stay in the U.S.
