How to Renew an Employment Authorization Document?

An Employment Authorization Document (EAD card), also known as a work permit, is issued to visa-holders who have the legal right to work in the U.S. An applicant can file an application for employment authorization, Form I-765, to apply for an EAD. Form I-765 is a USCIS form.

Steps to Apply for an EAD

1. The applicant first checks the category under which he/she would be eligible to file Form I-765, Application for Employment Authorization:

  • Asylee/Refugee categories
  • Nationality categories
  • Foreign students
  • Employment-based non-immigrant categories
  • Family-based non-immigrant categories
  • Other categories

2. The applicant completes Form I-765 and submits the application to USCIS with the fee of $380 and any required documents.

The applicant attaches the following documents with the package:

  • Two identical passport-style photographs
  • Copy of current passport
  • Copy of the USCIS Form I-94, Arrival-Departure Document issued when the applicant entered the U.S.
  • Copy of L1 petition, I-94, if applicable, as evidence that the applicant is a spouse of the principal visa holder

3. The applicant will receive a Form I-797 (Notice of Action) from USCIS, indicating that the application has been received.

4. If biometric services are required, the applicant needs to complete those at an Application Support Center.

5. If the application is approved, the applicant will receive an EAD card in the mail.
