How to File Form I-821D
Form I-821D is the application for Deferred Action. Deferred Action is a new policy for DREAMers, young undocumented people living in the U.S. who were brought to the country as children.
People granted Deferred Action are free from deporation for two years.
Steps to file Form I-821D
1. The applicant completes Form I-821D with all necessary information.
2. The applicant attaches relevant documents to support their case.
Relevant documents include proof that they meet all the eligibility requirements:

- They entered the U.S. before the age of 16.
- They are 30 years old or younger as of June 15, 2012.
- They have lived continuously in the U.S. since June 15, 2007 and up to the present time.
- They are at least 15 years of age at the time of filing.
- They meet the education requirements.
- They have not been convicted of a felony, a significant misdemeanor, or three or more misdemeanors.
3. The applicant completes Form I-765, Application for Employment Authorization, and Form I-765WS (I-765 worksheet).
4. The applicant attaches the filing fee of $465 for Form I-821D, I-765 and I-765WS.
This fee includes a $380 fee for Form I-765 and an $85 biometric services fee.
5. The applicant mails the application to the USCIS Lockbox facility.
The USCIS Lockbox facility address depends on the state where the applicant lives.
6. The applicant awaits confirmation from USCIS.
If the applicant has attached a completed Form G-1145, Notification of Acceptance of Application/Petition, with the application, they will receive an email/text message when their application has been accepted. Applicants will be issued a receipt number, which can be used to track their application.
7. If the application is approved, USCIS will send an approval notice and EAD card to the applicant.
The applicant will be granted two years of lawful status, subject to renewal, along with permission to work.
