How to File I-539

immigration-forms

The I-539 form, Application To Extend/Change Nonimmigrant Status, is used by non-immigrants to apply for an extension of stay or change to status. If you are in the U.S. as a temporary visitor on a non-immigrant visa (for instance, B1 or F1), then you are expected to leave the U.S. on the date indicated on your I-94. This is filled and affixed to you passport when you enter the country. If, for some reason, you want to extend the stay or change to another non-immigrant status, use the I-539 form to apply for the same.

Steps to File I-539

1. Fill out the I-539 form and attach the relevant processing fee. Note that the processing fee may differ based on the type of visa you hold or are applying a change to.

2. Mail the package to the appropriate USCIS or U.S. embassy address. Refer to the I-539 instructions to find out where to send your package.
