How to Get a Work Permit

Work permit is a document issued by USCIS that entitles its holder the legal right to work in the U.S. It is also called the Employment Authorization Document (EAD).

Non-resident aliens, living in the U.S. must file the I-765, Application for Employment Authorization at the USCIS for the EAD card, which is valid for a specific period of time based the on alien’s immigration situation.

Alien nationals with an EAD are permitted to work lawfully in the U.S., for any employer.

Steps to Get a Work Permit

1. Applicants who fit in the eligible categories can file the I-765 online and others may file a paper application.

2. The filing fee for the I-765 application is $380, and if you request consideration of deferred action for childhood arrivals, category (c) (33), an additional $85 biometric services fee must be paid.

3. If you are filing at the USCIS lockbox facility, you may attach the G-1145, E-Notification of Application/Petition Acceptance, if you wish to receive a text message or email when your application has been accepted.

4. Once accepted, your I-765 will be checked for completeness.

5. The USCIS may require for additional documents or require you to appear for an interview at the USCIS office. The originals of the copies submitted with your application will have to be produced, if needed for verification.

6. If a decision has not been made on your application even after 90 days, you can approach the USCIS for an interim work authorization, by appearing in person at your local USCIS office.

7. If approved, your work permit will be mailed to your address or you can pick it up from your local USCIS office.
